Terms of Service
These Terms of Service ("Terms") are a legal agreement between you and TechFix Property LLC ("TechFix Property," "we," "us," or "our"). By creating an account or using our platform, you agree to be bound by these Terms. If you do not agree, do not use TechFix Property.
1. The Platform
TechFix Property is an online marketplace that connects property owners and managers ("Clients") with independent maintenance professionals ("Technicians"). We provide tools for posting service requests, booking appointments, communicating, making payments, and managing property maintenance jobs.
TechFix Property is not a contractor, employer, staffing agency, or maintenance service provider. We provide a platform and related services only.
2. Eligibility
To use TechFix Property, you must:
- Be at least 18 years old
- Have the legal capacity to form a binding contract
- Not be barred from using the platform under applicable law
- Provide accurate, complete, and current registration information
By using TechFix Property, you represent that you meet these requirements.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you believe your account has been compromised.
You may not create multiple accounts, share your account with others, or use another person's account without authorization.
We may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to users or the platform.
4. Client Terms
As a Client, you agree to:
- Provide accurate information about your property, service needs, and access requirements
- Respond promptly to technician communications and scheduling requests
- Ensure safe access to the work area
- Pay for completed services through the platform
- Treat technicians with respect and professionalism
- Use the platform only for legitimate property maintenance needs
5. Technician Terms
As a Technician, you agree to:
- Provide accurate information about your qualifications, licenses, certifications, and experience
- Maintain all required licenses, permits, and insurance throughout your time on the platform
- Complete jobs professionally, on time, and to a reasonable standard of quality
- Communicate promptly with clients and TechFix Property
- Not solicit clients for off-platform transactions
- Comply with all applicable laws and professional standards
- Authorize and cooperate with background checks and credential verifications
Technicians are independent contractors, not employees of TechFix Property. TechFix Property does not control how Technicians complete their work, nor does it provide tools, equipment, or workplace benefits.
6. Service Fees and Payments
Clients pay for services through the TechFix Property platform. Payment is processed by our third-party payment processor (Stripe). Funds may be held in escrow until job completion is confirmed by the Client.
TechFix Property charges service fees to Clients and/or Technicians in connection with completed bookings. Current fee schedules are disclosed at the time of booking and may be updated with notice.
Technicians receive payouts according to our payout schedule. We may withhold payouts in cases of disputes, fraud investigations, or policy violations.
Clients are responsible for paying the amounts confirmed at booking. Additional charges (e.g., for unforeseen scope changes) require Client agreement before being applied.
7. Cancellations and Refunds
Cancellation and refund policies depend on timing and circumstances. Our current cancellation and refund policy is available in your account settings and may be updated from time to time.
In general, Clients who cancel with sufficient advance notice may receive a full or partial refund. Late cancellations may result in a cancellation fee to compensate Technicians for lost time.
If a Technician fails to show up, completes work that does not meet a reasonable standard, or materially misrepresents their qualifications, Clients may request a refund through our dispute resolution process.
8. Disputes Between Users
If a dispute arises between a Client and a Technician, we encourage both parties to communicate directly to resolve the issue. TechFix Property may assist with mediation but is not obligated to do so and does not guarantee any outcome.
TechFix Property's decision in a dispute, if it chooses to assist, is final and binding to the extent permitted by law.
9. Prohibited Conduct
You agree not to:
- Post false, misleading, or fraudulent information
- Solicit or accept off-platform payments to avoid service fees
- Harass, threaten, or harm any user
- Use the platform for any unlawful purpose
- Attempt to gain unauthorized access to accounts or systems
- Scrape, reverse-engineer, or misuse the platform
- Engage in discriminatory conduct in violation of applicable law
- Create fake reviews or manipulate ratings
- Submit false identity, license, or insurance information
10. Reviews and Ratings
Both Clients and Technicians may leave reviews and ratings after a completed job. Reviews must be honest, accurate, and based on your actual experience.
We may remove reviews that violate these Terms, contain false information, include personal attacks, or otherwise violate our community guidelines.
We do not edit or alter reviews on behalf of users.
11. Verification and Background Checks
We may conduct or commission identity verification, license checks, and background checks on Technicians. Verification does not guarantee a Technician's performance, safety, or suitability. Clients are encouraged to review profiles, ask questions, and exercise their own judgment.
Clients are responsible for granting access to their property. TechFix Property is not responsible for damage to persons or property arising from granting access to a Technician found through the platform.
12. Intellectual Property
TechFix Property and its licensors retain all rights to the platform, software, designs, logos, trademarks, and content we create. You may not copy, modify, distribute, or create derivative works from our intellectual property without prior written permission.
By submitting content (job descriptions, photos, reviews, messages) to the platform, you grant TechFix Property a non-exclusive, royalty-free, worldwide license to use, display, and reproduce that content in connection with operating and promoting the platform.
13. Privacy
Your use of TechFix Property is subject to our Privacy Policy, which is incorporated into these Terms by reference.
14. Third-Party Services
The platform may integrate with or link to third-party services, including payment processors, mapping, communications, and background-check providers. Your use of third-party services is governed by their terms and privacy policies. We are not responsible for third-party services.
15. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT WARRANT THE QUALITY, SUITABILITY, OR SAFETY OF ANY TECHNICIAN OR SERVICE BOOKED THROUGH THE PLATFORM.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TECHFIX PROPERTY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE PLATFORM, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.
IN NO EVENT WILL TECHFIX PROPERTY'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO TECHFIX PROPERTY IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MINIMUM EXTENT PERMITTED BY LAW.
17. Indemnification
You agree to indemnify, defend, and hold harmless TechFix Property, its officers, directors, employees, agents, and licensors from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the platform; (b) your violation of these Terms; (c) your violation of any law or the rights of a third party; or (d) any content you submit to the platform.
18. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles.
Any legal action arising out of these Terms or your use of the platform shall be filed exclusively in the state or federal courts located in Atlanta, Georgia, and you consent to the personal jurisdiction of those courts.
19. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
To the extent permitted by applicable law, any dispute arising out of or relating to these Terms or the platform that cannot be resolved informally shall be submitted to binding individual arbitration administered by a recognized arbitration body under its applicable rules.
YOU AND TECHFIX PROPERTY AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A CLASS OR REPRESENTATIVE ACTION.
Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.
20. Modifications to These Terms
We may update these Terms from time to time. We will notify you of material changes by email, dashboard notice, or other means. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms.
21. Termination
Either party may terminate this agreement at any time. You may close your account through your account settings. We may suspend or terminate your account if you violate these Terms, engage in prohibited conduct, or for any reason at our discretion with reasonable notice.
Upon termination, your right to use the platform ends. Provisions that by their nature should survive termination (including payment obligations, intellectual property, disclaimer, limitation of liability, and governing law) shall survive.
22. Entire Agreement
These Terms, together with our Privacy Policy and any additional policies referenced herein, constitute the entire agreement between you and TechFix Property with respect to the platform and supersede all prior or contemporaneous agreements.
23. Severability and Waiver
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision.
